Learn more about City of Hercules immigration policy and local support resources

Hercules is dedicated to safeguarding the constitutional rights of every individual in our city. Hercules is governed by the California Values Act, which prohibits the City from sharing personal information with ICE unless required by federal law or under very specific exceptions.

The Hercules Police Department does not allocate resources to investigate, detain or arrest individuals solely for immigration enforcement. The Hercules Police Department adheres to Hercules Police Department Policy # 427 on Immigration Violations, which states that: 

  • Local police do not ask about immigration status during routine interactions, and do not detain people solely based on immigration status.

  • City resources are not used to support federal immigration enforcement unless mandated by law.

  • Hercules does not comply with ICE detainer requests without a judicial warrant.

Residents should also be aware of their rights

  • You do not have to open the door unless ICE presents a signed warrant.

  • You have the right to remain silent.

  • You have the right to speak to a lawyer before answering any questions. 

  • You do not have to sign anything without legal representation.
